A warning handed over in anger can turn into a legal problem. Disciplinary rules UAE employers must follow list the penalties they may use. They also set the steps and the time limits. BITECH Middle East supports clients across staff outsourcing, contract staffing, and Employer of Record (EOR) services. We help each client document a fair process from the first notice.

This article explains what the disciplinary rules UAE law allows. It also covers suspensions, deadlines, and common mistakes.

What Do Disciplinary Rules UAE Law Allow?

The UAE government’s official page on disciplinary rules lists the penalties under Article 39 of Federal Decree-Law No. 33 of 2021. An employer can use these:

  • A written notice
  • A written warning
  • A wage deduction within the limit the law sets
  • Suspension without pay for up to 14 days
  • Loss of promotion for up to two years, where the company runs a promotion system
  • Termination of service, with end-of-service benefits protected

No other penalty counts as a lawful disciplinary measure. The penalty must also match the seriousness of the violation.

The Process Behind Disciplinary Rules UAE Employers Must Follow

Cabinet Resolution No. 1 of 2022 sets the controls for each penalty. An employer should work through these steps in order:

  1. Describe the violation in writing: The employee needs to know exactly what the claim is.
  2. Hear the employee: The employer listens to the employee’s account and defence.
  3. Investigate and record it: Write up the findings in minutes and keep them in the employee’s file.
  4. Choose a fair penalty: Match it to the seriousness of the violation and to the company’s penalty schedule.
  5. Notify the employee in writing: State the penalty, the reason, and what repeat behaviour would bring.

Each employer must also draw up a schedule of penalties. The schedule explains how the company applies each measure.

Time Limits Under the Disciplinary Rules UAE Law

Two deadlines protect employees. The employer cannot accuse a worker of a violation found more than 30 days earlier. The employer also cannot impose a penalty more than 60 days after the investigation ends and confirms the violation.

Slow action therefore weakens a case. Employers should open an investigation quickly and finish it promptly.

Suspension During an Investigation

Sometimes an employer needs the worker away from the workplace. The law allows a temporary suspension of up to 30 days for an investigation. The worker receives half of their wage during that time. If the case falls apart, the employer must pay the full wage for the suspension period.

A different rule applies when a worker faces a criminal charge. Suspension then carries no wages. If the worker clears their name, the employer reinstates them and pays the full wages for that period.

Employee Rights and Company Rules

An employee can submit a grievance to management against a penalty. The employer must not punish anyone for doing so, and must share the outcome.

Larger employers carry extra duties. A company with 50 or more workers needs a clear grievance system with written replies. It also needs internal work regulations. These cover penalties, promotions, and exit procedures. The employer must share them in a language workers understand.

Common Disciplinary Rules UAE Mistakes

  • Skipping the written notice: A verbal accusation does not meet the process.
  • Waiting too long: Missing the 30-day and 60-day limits can void a penalty.
  • Using an unlisted penalty: Only the penalties in Article 39 are lawful.
  • Suspending without pay by default: Investigation suspensions carry half pay.
  • Having no penalty schedule: Without one, similar cases end in different outcomes.

Before You Issue a Penalty

  1. Check the facts: Confirm what happened and when you found out.
  2. Count the days: Make sure you sit inside the 30-day window.
  3. Review your schedule: Find the penalty your own rules assign to this violation.
  4. Give the employee a hearing: Write down their response.
  5. Document everything: Keep notices, minutes, and decisions in one file.
